Terms of Service

These Terms of Service (“Terms”) govern your use of the Fuzion Stone Surfaces website (the “Site”). Fuzion Stone Surfaces is a business located in Mascotte, Florida (“Fuzion Stone Surfaces,” “we,” “us,” or “our”). By using the Site, you agree to these Terms, our Privacy Policy and our Acceptable Use Policy. If you do not agree, please do not use the Site.
1. Who may use the Site
You must be at least 18 years old to submit a request or enter into an agreement with us. By using the Site, you confirm that the information you provide is accurate and that you have authority to request work for the property involved.
2. Information only, not an offer or contract
The Site provides general information about our countertop products and services. Nothing on the Site is an offer, contract, guarantee or warranty. Using the Site or submitting a form does not create a contract or a customer relationship. Services, materials, colors and availability shown on the Site may change without notice.
3. Free estimates
- Estimates are free of charge and without obligation for properties within our standard service area (Lake, Sumter, Orange and surrounding counties).
- For properties farther away, a travel fee may apply based on distance. We will tell you about any fee before scheduling, and you can decide whether to proceed.
- Weekday appointments are available Monday through Friday, 9:00 AM to 5:00 PM. Saturday appointments are available by prior arrangement only.
- An estimate is based on the information available at the time, including measurements and details you provide. It is not a binding price.
- Final pricing depends on on-site measurement and templating, the material and slab you select, edge profiles, cutouts, site conditions and material availability.
- Any estimate is valid only for the period stated in it. Material prices may change after that period.
4. Your project agreement
All countertop work is performed under a separate written agreement signed by you and Fuzion Stone Surfaces. That agreement sets the scope of work, price, payment terms, schedule and any warranty. If anything on the Site conflicts with your written agreement, the written agreement controls. Your agreement may include notices required by Florida law, including, where applicable, notices under Florida’s Construction Lien Law (Part I of Chapter 713, Florida Statutes).
5. Natural stone and material disclaimers
We offer granite, quartz and marble. Granite and marble are natural materials, and quartz is an engineered stone. Please understand that:
- Color, veining, pattern, texture and markings vary from slab to slab and within a single slab. Natural pits, fissures and mineral deposits are normal characteristics, not defects.
- Photos, samples and online images are a general guide only. Colors may also look different on your screen.
- Seams are a normal part of most installations and may be visible to some degree.
- Quartz is made by third-party manufacturers. Their specifications, care requirements and warranties come from the manufacturer.
- No warranty is offered through this Site. Any warranty is provided only in your written agreement or by the material manufacturer.
6. Photos and content on the Site
Photos labeled as Fuzion projects show work completed by our team. Some other images on the Site are representative or illustrative and are used to show design ideas and materials. They may not depict a specific Fuzion project. All text, graphics, logos, photos and other content on the Site are owned by or licensed to Fuzion Stone Surfaces and are protected by copyright and trademark law. You may view and share pages for personal, non-commercial use. You may not copy, reproduce, modify or use our content or branding for any other purpose without our written permission.
7. Information you submit
You are responsible for the accuracy of information you send us. By submitting photos, measurements or messages, you give us permission to use them to respond to your request, prepare an estimate and provide our services. We handle that information as described in our Privacy Policy.
8. Acceptable use
Your use of the Site must follow our Acceptable Use Policy, which is part of these Terms.
9. Third-party links
The Site may link to websites run by others, such as social media platforms or material manufacturers. We do not control and are not responsible for those websites, their content or their practices.
10. Website disclaimer
To the fullest extent allowed by Florida law, the Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will always be available, error-free or free of viruses. Information on the Site, including material comparisons and care tips, is general guidance and not professional advice for your specific project.
11. Limitation of liability
To the fullest extent allowed by Florida law, Fuzion Stone Surfaces will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of, or inability to use, the Site. Our total liability for any claim arising from use of the Site is limited to one hundred dollars ($100). This section applies only to use of the Site. It does not limit our responsibilities under a signed project agreement, and it does not limit liability for gross negligence, intentional misconduct or anything else that cannot be limited under Florida law.
12. Indemnification
You agree to defend, indemnify and hold harmless Fuzion Stone Surfaces and its owners, employees and agents from any claims, losses or expenses, including reasonable attorneys’ fees, arising from your misuse of the Site, your violation of these Terms or the Acceptable Use Policy, or your violation of anyone else’s rights.
13. Your rights as a Florida consumer
Nothing in these Terms limits any right you have under the Florida Deceptive and Unfair Trade Practices Act (Part II of Chapter 501, Florida Statutes) or any other consumer protection law that cannot be waived by agreement.
14. Governing law and where disputes are handled
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Before filing any claim, both parties agree to first try to resolve the issue informally by contacting the other in writing and allowing 30 days to work it out. If the dispute is not resolved, it must be brought only in the state courts located in Lake County, Florida, or in the United States District Court for the Middle District of Florida, and you and Fuzion Stone Surfaces consent to the jurisdiction of those courts. Claims that qualify may be brought in small claims court. Disputes about a specific project are governed by the dispute terms in your written agreement.
15. Other terms
- Changes. We may update these Terms by posting a new version on this page with a new effective date. Continued use of the Site means you accept the updated Terms.
- Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to do so later.
- Entire agreement. These Terms, the Privacy Policy and the Acceptable Use Policy are the entire agreement between you and us about use of the Site. A signed project agreement governs any work we perform.
